Acceptance of Terms
Ride Car Sharing ("Ride," "we," "us," or "our") operates a peer-to-peer car sharing marketplace platform. Ride is NOT a car rental company, insurance provider, or transportation carrier. We do not own, operate, maintain, inspect, or insure any vehicles. We are a technology marketplace that facilitates connections between independent vehicle owners ("Hosts") and renters ("Guests"). By using our platform, you agree to these Terms, including the binding arbitration clause and class action waiver.
Eligibility
Guests: Must be 21+ with a valid, unrestricted driver's license. Guests aged 21-24 pay a $15/day young driver surcharge. International licenses accepted with valid passport. Hosts: Must be 21+, legal owner of the vehicle, maintain active auto insurance meeting state minimums (PR: SRO; FL: 10/20/10; CA: 15/30/5; NY: 25/50/10; TX: 30/60/25), notify insurer of P2P sharing, and list vehicles 15 years old or newer with under 150,000 miles.
Booking and Reservations
Reservations are subject to availability and may require a deposit at the time of booking. Ride reserves the right to modify or cancel reservations due to unforeseen circumstances.
Cancellation Policy
Guest: Free cancellation up to 48 hours before pickup. 24-48 hours: 50% of first day's rate. Under 24 hours: 100% of first day's rate. No-shows: full trip amount charged. Host: 1st cancel = warning. 2nd in 90 days = $50 fee. 3rd = $100 + 30-day search suppression. 4th+ = account review/suspension. Guests receive compensation: one day's rate for 2+ day trips, half day for shorter trips.
Payment and Pricing
Payment is processed through our secure hosted payment system. Total includes: base daily rate, platform service fee (10%), Trip Protection fee (if selected), optional add-ons, delivery fee (if applicable), cleaning fee (if applicable), and taxes. Security Deposit: $250 refundable hold at booking (host may set up to $500). Released within 48 hours of clean return. Late Return: 30-minute grace period. After: $25/hour. 2+ hours late: full extra day at daily rate. 6+ hours with no communication: security deposit forfeited. Mileage: 200 miles/day included (host may set different limit). Excess: $0.35/mile. Fuel: Return at same level. Shortage: $5/gallon + $25 refueling fee. EV: $0.30/kWh + $15 charging fee. Tolls: With Toll Pass add-on ($3.50/day): unlimited toll usage. Without: tolls charged by plate match + $5 admin fee per toll (up to 90 days post-trip).
Vehicle Use
Only the registered guest may drive. Prohibited: off-road driving, racing, towing, commercial use, smoking/vaping (unless listing permits), pets (unless listing permits), driving under influence, illegal activity. Must comply with all traffic laws. Must return at agreed time and location. Cleaning fees: Light $30, Medium $75, Heavy $150, Severe $250. Smoking violation: $250. Unauthorized pets: $150. Violation of any restriction immediately voids Trip Protection and may result in full financial liability, security deposit forfeiture, and account suspension.
Trip Protection Program
THE TRIP PROTECTION PROGRAM IS NOT INSURANCE. It is a limited contractual reimbursement program. Basic (Free): No reimbursement. Guest pays all damages. Host files with own insurer. Standard ($12/day): Ride reimburses host's insurance deductible up to $1,000. Premium ($22/day): Ride reimburses host's insurance deductible up to $2,500. HOST REIMBURSEMENT: When a Guest selects Standard or Premium, Ride reimburses the host's insurance deductible only — the amount the host's insurer charges before covering the repair. We do NOT pay repair costs directly. NOT COVERED (all tiers): Tires, glass/windshield, wear and tear, mechanical breakdown, interior damage from normal use, personal property, liability to others, unauthorized drivers, off-road/illegal use, pre-existing damage. OPTIONAL ADD-ONS (sold separately if host offers): Tire Protection ($5/day), Glass Protection ($4/day), Roadside Assistance ($6/day), Toll Pass ($3.50/day). IF HOST LACKS VALID INSURANCE: Ride is NOT responsible for any damage and no deductible reimbursement will be made.
Host Responsibilities
Hosts must: maintain auto insurance meeting state minimums, notify insurer of P2P sharing, keep vehicle in safe/roadworthy condition, provide accurate descriptions and photos, be available during pickup/return, report known issues. HOST INDEMNIFICATION: Hosts agree to indemnify Ride against all claims arising from vehicle condition, operation, maintenance, insurance gaps, or breach of these Terms. This includes attorneys' fees and costs. Ride does NOT verify or guarantee any host's insurance coverage.
Dispute Resolution
Informal Resolution: Contact support@ride-carsharing.com. Allow 30 days for resolution. Accident Procedure: Ensure safety → photos of all damage → exchange info → report in Trip Chat within 1 hour → police report if damage exceeds $500 → DO NOT admit fault → contact personal insurer within 24 hours. Binding Arbitration: Unresolved disputes settled through binding individual arbitration under AAA rules. CLASS ACTION WAIVER: Each party may bring claims only individually, not as plaintiff or class member in any class action. Governing Law: Commonwealth of Puerto Rico. Data Usage: All messages, photos, inspection images, GPS data, and trip activity may be used as evidence in claims and disputes.
Limitation of Liability
RIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. RIDE'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) PLATFORM FEES PAID IN THE PRECEDING 12 MONTHS, OR (B) $100. YOU ACKNOWLEDGE THAT RIDE DOES NOT PROVIDE INSURANCE AND THAT TRIP PROTECTION IS A LIMITED CONTRACTUAL BENEFIT. YOU ASSUME ALL RISK ASSOCIATED WITH USING THE PLATFORM.
Privacy
Your use of Ride is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using Ride, you consent to the practices described therein.
Changes to Terms
Ride reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email or through the platform. Continued use of the service constitutes acceptance of updated terms.
